Terms & Conditions

By accessing or using Fit Territory ("the App", "Service"), you agree to these Terms and Conditions ("Terms"), our Privacy Policy, and any other policies we may adopt. These Terms constitute a legally binding agreement between you and Fit Territory ("we", "us", "our").

We reserve the right to modify these Terms at any time. Significant changes will be communicated via in-app notification or email. Continued use of the App after changes constitutes acceptance of the revised Terms.

To use Fit Territory, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• If between 13–17 years old, have obtained parental or guardian consent
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using the app under applicable laws
• Have a compatible Android device with the required operating system version

By using the App, you represent and warrant that you meet all of the above eligibility requirements.

To access full features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and not share it with third parties
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that contain false information, are inactive, or violate these Terms.

If the App allows you to submit any content (such as profile pictures, usernames, or future community features), you represent that:

• You own or have the necessary rights to submit the content
• The content does not violate any third-party rights
• The content is not offensive, defamatory, or unlawful

By submitting content, you grant us a worldwide, royalty-free, perpetual license to use, reproduce, and display the content in connection with the Service.

We reserve the right to remove any user content that violates these Terms or our community guidelines.

Your use of Fit Territory is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:

• The App requires continuous background location access to function
• Your username and game stats are publicly visible to other users
• We do not sell your personal data to third-party advertisers
• You can request deletion of your data by contacting us

All intellectual property rights in and to the App — including but not limited to the software, design, graphics, logos, icons, text, game mechanics, and underlying technology — are owned by or licensed to Fit Territory.

These Terms do not grant you any right or license to use any trademark, service mark, or logo. Unauthorized use of our intellectual property is strictly prohibited.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FIT TERRITORY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or profits arising from your use or inability to use the App
• Personal injury or property damage resulting from your use of the App
• Unauthorized access to or alteration of your data
• Statements or conduct of any third party on the Service

Our total liability to you for all claims shall not exceed the amount you have paid us in the past 12 months (or INR 1,000 if no payment has been made).

You agree to defend, indemnify, and hold harmless Fit Territory and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including attorney's fees) arising out of:

• Your use of or inability to use the App
• Your violation of these Terms
• Your violation of any rights of a third party
• Any content you submit through the App
• Your physical activity conducted while using the App

We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause, and with or without notice, including if:

• You breach any provision of these Terms
• We suspect fraudulent, abusive, or illegal activity
• We are required to do so by law
• We decide to discontinue the App or any feature

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that should survive termination by their nature will survive.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiations. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, in the jurisdiction of Gujarat, India.

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

• Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Fit Territory.
• Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
• Waiver: Our failure to enforce any provision does not constitute a waiver of that right.
• Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
• Force Majeure: We are not liable for failures caused by events beyond our reasonable control.
